Accra Court fines two individuals GH¢90,000 each for land fraud

The Circuit Court has levied a fine of GH¢ 90,000 each on two individuals, Daniel Botchway and Shadrack Moyom Dimang, for their involvement in fraudulent land transactions. Should they default on payment, they will serve seven years in prison each. The charges from their conspiracy to defraud a couple of GH¢ 300,000 under the pretence of selling them a parcel of land, which ultimately failed.

Presided over by Mrs. Susana Eduful, the court found the accused guilty of conspiracy to commit a crime. Additionally, Daniel Botchway was found guilty of fraudulent land transactions and was fined GH¢ 90,000, with a default prison term of seven years. Both sentences are to run concurrently.

According to Deputy Superintendent of Police (DSP) Evans Kesse, the complainants, a couple residing in , sought to purchase land in Tse-Addo, near La in , in May 2020. Dimang introduced Botchway to the couple, claiming they had land for sale. The accused provided a site plan allegedly undergoing processing at the Lands Commission.

The complainants, after inspecting the land, expressed interest and deposited GH¢ 300,000 as part of payment into Botchway's accounts at . However, it was later discovered that the land had been granted to another person. Subsequently, three postdated cheques, each valued at GH¢ 100,000, issued by Botchway were dishonoured upon presentation in August 2021.

Following a complaint to the Accra Regional CID in November 2021, the accused were arrested. They admitted to the offence and promised to refund the money. Botchway refunded GH¢ 20,000 via a Fidelity Bank cheque, leaving a balance of GH¢ 280,000.
