Colonel Kwadwo Damoah, a former Commissioner of the Customs Division at the Ghana Revenue Authority (GRA), has secured victory in the New Patriotic Party's (NPP) parliamentary primary for the Jaman South Constituency.
His win, with 289 votes, comes in the wake of a recent legal triumph where the High Court in Accra quashed a report by the Office of Special Prosecutor (OSP) accusing Damoah of wrongdoing in the Labianca case.
Damoah's victory in the parliamentary primary reflects a significant turn of events following the November 27, 2023, court ruling.
The High Court not only nullified the OSP's report but also awarded costs of GH¢10,000 against the prosecuting body.
The OSP's report had implicated Colonel Kwadwo Damoah and Joseph Adu Kyei, a former Deputy Commissioner of the Division, in allegedly granting favourable tax treatment to Labianca Company, a frozen foods company owned by Council of State member Eunice Jacqueline Buah Asomah-Hinneh.
In response, Damoah and Kyei filed a lawsuit in November 2022, challenging the merit of the report and claiming damage to their reputations.
The recent court ruling sided with the plaintiffs, asserting that the OSP had exceeded its authority in making adverse findings.
The court further issued an order of prohibition restraining the OSP from conducting further investigations into Damoah and Kyei regarding the Labianca case.
Expressing satisfaction with the court's decision, the lawyer for the plaintiffs, Bob Senyalah, deemed it a victory for justice.
“The court awarded GH¢10,000 cedis cost against the OSP. The court further granted an order of prohibition restraining the OSP from purporting to continue or conduct further investigations against the applicant.”
In other NPP parliamentary primary results, Pius Enam Hadzide, the Chief Executive Officer of the National Youth Authority (NYA), emerged victorious in the Asuogyaman constituency with 423 votes.
